These Terms and Conditions (Agreement) govern the reservation and use of the facilities and services of Hotel Lindenhof (Hotel), operated by Crossworld AG (Operator). By making a reservation or utilizing the Hotels services, the guest (Guest or You) agrees to this Agreement.
1. Definitions
1.1 "Hotel" refers to Hotel Lindenhof, including all facilities and services offered, operated by Crossworld AG.
1.2 "Crossworld AG" or "Operator" refers to the legal entity responsible for the management and operation of the Hotel.
1.3 "Guest" means any natural or legal person making a reservation or using the Hotel's facilities or services.
1.4 "Reservation" is the contractual agreement between the Guest and the Operator for the provision of accommodation and associated services.
2. Reservation and Payment
2.1 Booking Process. Reservations can be made directly through the Hotel website, by phone, or through authorized third-party providers. All reservations are subject to availability and confirmation by the Operator.
2.2 Payment Terms. A valid credit card or an alternative approved payment method must be provided at the time of booking. Payment terms, including any deposits or full payments, will be communicated during the booking process.
2.3 Deposit. A deposit of CHF 200.00 will be charged at or before check-in. This deposit serves as security for any potential damages or missing items in the room. If the room is left in proper condition, the deposit will be refunded to the specified account within 7 working days.
2.4 Currency. All transactions will be made in the local currency unless otherwise stated.
3. Cancellation and Refund
3.1 Cancellation by the Guest. Guests may cancel their reservation according to the deadlines and fees specified at the time of booking. Any refunds will be processed in accordance with the applicable conditions at that time.
3.2 Cancellation by the Operator. The Operator reserves the right to cancel reservations due to reasons such as overbooking, emergency maintenance, or unforeseen circumstances. In such cases, the Operator will offer alternative accommodations or refund the full amount.
4. Check-In and Check-Out
4.1 Check-In. Check-in begins at 3:00 PM local time.
4.2 Check-Out. Check-out must be completed by 11:00 AM local time on the departure day.
4.3 Early Check-In / Late Check-Out. Requests for early check-in or late check-out are possible, subject to availability, and may incur additional fees.
4.4 Identification. All guests are required to present a valid ID at check-in.
5. Guest Behavior and House Rules
5.1 Behavior. Guests agree to behave respectfully and comply with all hotel policies, posted rules, and applicable local laws.
5.2 Prohibited Actions. Activities such as the use of illegal substances, excessive noise, vandalism, or any disruptive behavior are strictly prohibited. The Operator reserves the right to exclude a guest without refund in case of violation.
5.3 Damage and Losses. Guests are responsible for any damage to or loss of hotel property occurring during their stay. Repair or replacement costs will be charged to the guest.
6. Limitation of Liability and Disclaimer
6.1 Limitation of Liability. To the extent permitted by law, neither the Hotel nor Crossworld AG is liable for indirect, incidental, or consequential damages arising in connection with a guest's stay, including personal injury, property loss, or theft.
6.2 Disclaimer. The Operator makes no guarantees regarding the accuracy, reliability, or completeness of the provided information. It is recommended that guests verify all details independently.
6.3 Health and Safety. Participation in activities at the hotel is at the guest’s own risk. The hotel is not liable for injuries occurring on the premises, unless due to gross negligence or willful misconduct by the Operator.
7. Data Protection
7.1 Data Collection and Use. The Operator collects and processes personal data in accordance with applicable data protection laws solely for the purpose of managing reservations and improving services.
7.2 Disclosure to Third Parties. Personal data may be shared with authorized third parties when necessary to carry out the reservation and provide the services.
8. Force Majeure
8.1 Events of Force Majeure. The Operator is not liable for failure to fulfill its obligations under this Agreement if such failure is due to events beyond its reasonable control, such as natural disasters, government orders, or other emergencies.
8.2 Alternative Arrangements. In the event of a force majeure, the Operator may, at its discretion, offer alternative accommodations or provide a refund.
9. Dispute Resolution
9.1 Governing Law. This Agreement is governed by the laws of the Canton of Bern.
9.2 Jurisdiction. Any disputes arising from or in connection with this Agreement shall be exclusively resolved in the courts of the Canton of Bern.
9.3 Alternative Dispute Resolution. The parties agree to first attempt to reach an amicable settlement or mediation before initiating legal action.
10. Changes
10.1 Right to Modify. The Operator reserves the right to amend this Agreement at any time. Any changes will be communicated to guests via the Hotel website or by email. Continued use of the Hotel's services after notification of the changes will be considered as acceptance of the modified terms.
11. Pool Rules
11.1 Scope. These pool rules apply to the swimming area of Hotel Lindenhof and bind all users of the pool.
11.2 Opening Hours. The pool is open daily from 8:00 AM to 8:00 PM.
11.3 Hygiene. All guests must shower before entering the pool.
11.4 Disinfection. Chlorine is used as a disinfectant in the pool.
11.5 Personal Items. The Operator is not liable for damage, destruction, or loss of items brought into the pool area.
11.6 Compliance with Instructions. Each guest is required to follow the instructions of the pool staff.
11.7 Supervision. The hotel and staff do not assume responsibility for supervising minors, non-swimmers, or individuals with physical or mental disabilities. Supervision is the sole responsibility of the parents or authorized companions.
11.8 Liability. The Hotel is not liable for injuries or damages resulting from non-compliance with these pool rules, disregarding staff instructions, negligence of users (including contributory negligence), or unforeseen circumstances (including force majeure or third-party interventions). This also applies to other facilities (e.g., sauna).
11.9 Prohibited Actions. The consumption of alcohol and smoking are strictly prohibited in the pool area.
11.10 Child Safety. Children under 14 years of age may only use the pool when accompanied by a parent or guardian who assumes full supervision responsibility.
11.11 Youth Protection. Applicable youth protection laws, particularly those concerning alcohol, tobacco, and other restrictions, must be adhered to by all guests and their guardians.
11.12 Cleanliness. Guests are responsible for maintaining high cleanliness standards throughout the pool area. Additionally, general swimming regulations (e.g., SLRG) must be observed.
11.13 Health. Individuals with contagious diseases are not permitted to enter the pool area.
11.14 Privacy Rights. Photography or filming of individuals without their express consent is prohibited.
11.15 Designated Use. Pool facilities and equipment may only be used for their intended purpose.
11.16 Reporting Obligation. Accidents, emergencies, thefts, or complaints must be reported immediately to the relevant staff or reception.
11.17 Diving and Safety. Diving is strictly prohibited. Entering the pool from the side and pushing other people is forbidden. Due to increased slipperiness, cautious behavior is recommended; wearing swimming shoes is advised.
11.18 Rental Items. Bathrobes and slippers can be rented at the reception for CHF 10 per person.
11.19 First Aid. Each guest is required to provide first aid or other assistance in an emergency, as far as possible.
12. Pet Policy
12.1 General. Pets are allowed in designated areas and require prior approval from the Operator.
12.2 Approval and Fees. Bringing pets requires prior approval from the Operator and may incur additional fees.
12.3 Responsibility. The Guest is solely responsible for their pet's behavior and any damage caused by the pet to hotel property.
12.4 Leash and Containment. Pets must be kept on a leash in public areas of the hotel or housed in appropriate transport containers.
12.5 Hygiene and Consideration. The Guest must ensure that their pet does not cause inconvenience and that any waste is immediately cleaned up. All local pet hygiene regulations must be followed.
12.6 Exclusion. The Operator reserves the right to exclude certain pets, especially those deemed aggressive or otherwise unsuitable.
Confirmation and Consent
By making a reservation or using the services of Hotel Lindenhof, the Guest confirms that they have read, understood, and accepted these Terms and Conditions.
